GENERAL TERMS AND CONDITIONS OF SALE – Gardafoody

The offer and sale of Products on the website gardafoody.com of SANTA S.A.S. di Sanfelici Luca e C., VAT No. 03944720980 – Registered office: Via Colombare 49, 25019 Sirmione (BS), Italy (hereinafter "Gardafoody" or "the Supplier") are governed by the following general terms and conditions of sale.

These General Terms and Conditions of Sale (hereinafter, the "Terms") apply to all contracts for the sale of wines, alcoholic beverages and food products, including packaged food products made by third parties (hereinafter, the "Products"), concluded between the Supplier and the customer (hereinafter, the "Customer").

1. Orders Orders may be placed by the Customer via the website gardafoody.com or via other sales channels made available by the Supplier. Orders are deemed accepted by the Supplier only after a written order confirmation has been sent to the Customer.

2. Sale of alcoholic beverages The sale of wines and alcoholic beverages is reserved exclusively for customers of legal age (18 years or older). By placing an order, the Customer declares that they are at least 18 years old. The Supplier reserves the right to cancel orders if it has reason to believe that the Customer is a minor.

3. Shipping Products will be shipped to the address provided by the Customer when placing the order. The Supplier shall not be liable for any delivery delays due to causes not attributable to the Supplier.

4. Returns The Customer has the right to withdraw from the contract within 14 days of receiving the Products, without having to give any reason. In the event of withdrawal, the Customer must return the Products to the Supplier in the same condition in which they were received, at the Customer's own expense. By law, the right of withdrawal is always excluded for food products and for the supply of goods which are liable to deteriorate or expire rapidly.

5. Order cancellation The Customer may cancel an order before it has been shipped by the Supplier. In the event of cancellation, the Customer will receive a full refund of the price paid for the Products.

6. Liability The Supplier shall be liable only for direct damages caused by wilful misconduct or gross negligence of the Supplier itself. Under no circumstances shall the Supplier be liable for indirect or consequential damages.

7. Warranty The Supplier warrants that the Products conform to the description provided on the Supplier's website and are free from defects. In the event of defects, the Customer must notify the Supplier within 8 days of receiving the Products, and the Supplier will replace the defective Products or refund the price paid by the Customer.

8. Governing law and jurisdiction The contract is governed by Italian law. The Court of Brescia shall have exclusive jurisdiction over any dispute relating to the interpretation, performance or termination of the contract.

9. Consumer Code These Terms are drawn up in accordance with the provisions of the Italian Consumer Code (Legislative Decree No. 206 of 6 September 2005) and, in particular, with the provisions on distance contracts and off-premises contracts.
